Since last night’s decision to defund Flock cameras in Taos, one question keeps popping up on social media: When will they be removed?
I think the quick and dirty of it is that no one knows at this point. As I understand it, there are at least two main steps.
Terminate the Agreement
The agreement states that it can be terminated 30 days after being notified of funding not being appropriated. From the agreement:
11.16 Non-Appropriation. Notwithstanding any other provision of this Agreement, all obligations of the Customer under this Agreement which require the expenditure of funds are conditioned on the availability of funds appropriated for that purpose. Customer shall have the right to terminate this Agreement for non appropriation with thirty (30) days written notice without penalty or other cost.
Did that happen today? We’re not sure, but hopefully council members and press can stay on top of that.
Removal of Cameras
Here’s where the big question lives. The agreement is vague on the removal timing upon termination. Here’s the agreement language:
7.2 Termination. Upon termination or expiration of this Agreement, Flock will remove any applicable Flock Hardware at a commercially reasonable time period.
The “commercially reasonable time period” is not defined in the agreement.
Will Cameras Be Turned Off Beforehand?
Another good question that I do not have an answer for. It should be easy to check, however. Stand below a camera at night and wait for a vehicle to pass. If it’s on, the infrared will flash numerous times. There may also be a faint light, possibly blue.
If the AC junction box is visible, there should be two lights that indicate power.
I assume they will stay on until at least the 30-day non-appropriation period ends.
